Welcome to the Cave Art LLC website ("Site"), located at primalcaveart.com and hosted by Shopify Inc. By accessing, browsing, or purchasing products through this Site, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use this Site.
Throughout these Terms, the words "we," "our," and "us" refer to Cave Art LLC, and "you" refers to the customer or visitor using this Site.
1. Our Art & Print Fulfillment
Made-to-Order Products
All artwork sold through this Site is produced on a made-to-order basis. Products are professionally printed, packaged, and shipped by Fine Art America/Pixels, our trusted third-party print fulfillment partner.
Because every order is custom produced after purchase, production begins shortly after an order is placed.
Product Images & Color Accuracy
We make every reasonable effort to display our artwork as accurately as possible. However, colors, brightness, contrast, and overall appearance may vary slightly due to differences between computer monitors, mobile devices, printers, inks, and printing materials.
Minor variations in color, placement, or print quality that naturally occur during the printing process are not considered defects.
2. Payments, Billing & Pricing
Payment Authorization
By placing an order, you authorize Cave Art LLC to charge your selected payment method for the full purchase price, including applicable taxes and shipping charges. Orders are billed immediately upon checkout.
Payment Security
Payments are processed securely through Shopify and its authorized payment providers, including Shop Pay, major credit cards, and supported digital wallets. Cave Art LLC does not store your payment card or digital wallet information on its own servers.
Pricing
All prices are listed in U.S. Dollars unless otherwise stated. We reserve the right to modify prices, promotions, discounts, or product availability at any time without prior notice.
Order Acceptance
Receipt of an order confirmation does not constitute acceptance of your order. We reserve the right, at our sole discretion, to refuse, cancel, or limit any order for reasons including suspected fraud, pricing errors, product availability, payment issues, or violation of these Terms. If an order is canceled after payment has been received, a full refund will be issued. Whenever reasonably possible, we will notify you using the email address provided during checkout.
3. Shipping & Delivery
Delivery Estimates
Estimated shipping times are estimates only and are not guaranteed. Cave Art LLC is not responsible for delays caused by carriers, weather, customs, supply shortages, production delays, force majeure events, or fulfillment partner delays.
Shipping Address Accuracy
Customers are responsible for providing an accurate shipping address. If you discover an address error, contact info@primalcaveart.com immediately. If production has not begun, we will make reasonable efforts to update the address. Once production or shipment has begun, changes may no longer be possible.
4. Order Cancellations
Because every product is custom printed after purchase, cancellation requests are time-sensitive. Orders may be canceled only before production begins.
5. Returns, Damaged Items & Refunds
Custom products generally cannot be returned for buyer's remorse, ordering the wrong size, accidental purchases, or normal color variation. If artwork arrives damaged, defective, or incorrect, notify info@primalcaveart.com within 10 days with photos and your order number. We may replace the item or issue a partial or full refund.
6. Intellectual Property
All artwork and website content are the exclusive intellectual property of Cave Art LLC. Purchasing artwork transfers ownership only of the physical item. You may not reproduce, distribute, modify, or use our artwork for AI training or commercial purposes without written permission.
7. Data Privacy & Cookies
Personal information is handled according to our Privacy Policy. Shopify securely hosts this Site. Cookies and similar technologies are used to operate and improve the Site.
8. Prohibited Uses
You may not violate laws, infringe intellectual property, submit fraudulent information, interfere with Site security, upload malicious code, scrape content, or use our artwork for AI training without permission.
9. Limitation of Liability
To the fullest extent permitted by law, Cave Art LLC shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages. Total liability shall not exceed the amount paid for the order at issue.
10. Indemnification
You agree to indemnify and hold harmless Cave Art LLC, its owner, affiliates, contractors, and fulfillment partners from claims arising from your misuse of the Site or violation of these Terms.
11. Force Majeure
Cave Art LLC shall not be liable for delays caused by events beyond its reasonable control.
12. Governing Law
These Terms are governed by the laws of the State of Maine.
13. Severability
If any provision is unenforceable, the remaining provisions remain in effect.
14. Entire Agreement
These Terms and our Privacy Policy constitute the entire agreement regarding use of this Site.
15. Changes to These Terms
We may revise these Terms at any time. Continued use of the Site constitutes acceptance of revised Terms.
